Welcome to C. Brown’s Electrical Equipment. By using this website and placing an order you agree to these terms and conditions. We make every effort to ensure product descriptions, images and prices are accurate, but errors may occur and we reserve the right to correct them before completing an order. All products are subject to availability. Prices are shown in GBP (£) and include VAT where applicable. Payment must be made in full at checkout and we accept major debit and credit cards along with other secure payment methods shown on our site. Our shipping and returns processes are explained in full on the Shipping Policy and Returns & Refunds Policy pages, which form part of these terms. Many products are supplied with a manufacturer’s warranty, which does not cover misuse, accidental damage or normal wear and tear. Products must be installed and used in line with manufacturer instructions, and we are not liable for any indirect or consequential loss arising from their use. SUBSCRIPTION PLANS — STANDARD TERMS & CONDITIONS
These terms apply to all plans: Bronze, Silver, Gold, and Platinum.
1. Contract Duration
This plan is valid for 12 months from the date of activation and will automatically renew unless cancelled in writing at least 30 days prior to the renewal date.
2. Scope of Work
This plan covers only the services explicitly listed above. Any additional works identified during visits will be quoted separately and are not included in the plan fee.
3. Call-Out Entitlement
Call-outs are allocated as stated in the plan and are valid for the 12-month period. Unused call-outs do not roll over to the following year. Call-outs are subject to a fair-use policy and cover standard fault diagnosis and minor remedial works only.
4. Response Times
Business-hours plans: next available working day. 24/7 plans: we aim to respond within 4 hours for urgent faults. Response times are not guaranteed and may vary due to demand or circumstances beyond our control.
5. Access
The customer must ensure safe and unobstructed access to all relevant equipment at the agreed times. Scheduled inspections will be arranged at a mutually convenient time. Missed appointments due to access issues will be counted as a call-out.
6. Deposit Policy
Where a deposit is required prior to works commencing, the deposit payment is made to purchase materials for the agreed works. It comprises the following costs: materials, administrative costs, pre-purchase orders, fuel costs, logistics, and labour or the cost of our initial visit.
7. Non-Refundable Deposit
The deposit payment is non-refundable and constitutes a binding contract between C Brown Electrical and the client. By making the deposit payment the client acknowledges and agrees to these terms.
8. Payment Terms
Plan fees are due annually in advance unless otherwise agreed in writing. The client has 48 hours from receipt of any invoice to make payment. After 48 hours, a late payment charge of 10% of the full invoice value will be applied, calculated on a weekly basis until the invoice is settled in full. Failure to maintain payment may result in suspension of the plan.
9. Exclusions
The plan does not cover damage caused by misuse, third-party interference, flood, fire, or other acts of God; structural modifications; or consumables beyond standard lamp and battery changes. C Brown Electrical reserves the right to refuse a call-out where the reported fault falls outside the scope of this plan.
10. Liability
C Brown Electrical's liability under this plan is limited to the direct cost of services provided. We accept no liability for indirect, consequential, or incidental losses arising from equipment failure or service delays between scheduled visits. Nothing in these terms limits liability for death or personal injury caused by negligence.
11. Data Protection
C Brown Electrical will process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Client data will be used solely for the purposes of delivering services under this plan and will not be shared with third parties without consent, except where required by law.
12. Cancellation
Either party may cancel this plan with 30 days' written notice. In the event of cancellation by the customer, a pro-rata refund may be issued at C Brown Electrical's discretion. No refund will be issued where the plan has been used in full, for unused call-outs, or where cancellation arises from a breach of these terms by the client.
13. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing formal legal action. C Brown Electrical may refer unresolved payment disputes to a debt recovery service or the courts.
14. Governing Law
This agreement is governed by the laws of England and Wales. Any disputes arising from or in connection with this plan shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Amendments
C Brown Electrical reserves the right to update these terms and conditions with 30 days' written notice to the client. Continued use of the plan following notice of changes constitutes acceptance of the updated terms.
